These terms govern your use of the gymbuddy iPhone app. By using the app you agree to them. If you don't, please don't use the app.

Eligibility

You need to be at least 13 to use gymbuddy. If you're between 13 and the age of legal majority where you live, you're confirming a parent or guardian has agreed to these terms on your behalf.

Your account

You're responsible for keeping your Sign in with Apple credentials secure and for everything that happens under your account. Don't impersonate anyone, and please give us accurate information. We can suspend or terminate accounts that break these rules.

Your content

You own the photos, captions, locations, and other things you post ("your content"). You give gymbuddy permission to host, store, resize, and display your content as needed to run the app and show your posts to your friends. By posting, you're confirming you actually have the right to share what you're sharing.

What's not okay

Don't:

• Post anything illegal, harassing, hateful, threatening, or sexually explicit, or that infringes someone else's rights.
• Impersonate someone or misrepresent who you are.
• Spam, scrape, reverse-engineer, or interfere with the app.
• Share another person's location without their permission.
• Use the app to encourage self-harm or unhealthy exercise behavior.

We can remove content or suspend accounts that violate these.

Privacy

Your use is also governed by our Privacy Policy.

App Store

If you got the app from Apple's App Store, Apple's standard EULA also applies. Apple is a third-party beneficiary of these terms with respect to that EULA. Apple isn't responsible for the app or any claims relating to it.

Disclaimers

The app is provided "as is" without warranties of any kind. We don't promise it'll always work, be bug-free, or that your data will always be there. gymbuddy is a way to share workouts with friends; it's not a fitness, medical, or health advisor. Talk to a qualified professional before starting any new exercise program.

Limitation of liability

To the maximum extent permitted by law, gymbuddy and its affiliates aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the app. Our total liability won't exceed what you paid us in the 12 months before the event giving rise to the claim (or $20 USD if you paid nothing).

Termination

You can stop using the app and delete your account in Settings whenever you want. We can suspend or terminate access if you break these terms or if we discontinue the app.

Changes

If we update these terms in a meaningful way, we'll let you know in the app. Continued use means you accept the new version.

Governing law

These terms are governed by the laws of the State of New York, USA. You agree to the exclusive jurisdiction of state and federal courts in New York County, New York for any dispute that can't be resolved informally.
